The embattled Special Assistant on Domestic Matters to the former President Goodluck Jonathan, Waripamo-owei Emmanuel Dudafa, has petitioned the Chairman, National Human Rights Commission, over alleged desperation of the Economic and Financial Crimes Commission (EFCC) to keep him perpetually in Prisons custody
Dudafa in the petition dated November 4, 2016, stated that since he was arrested by the anti-graft agency on April 17, 2016, and arraigned on June 15, 2016, before Justice Mohammed Idris and Babs Kuewumi of Federal High Court, in Lagos and admitted to bail, on the following conditions
"That he is hereby release on bail in the sum of N500 million with three sureties in like sum.
The sureties shall be landed property owner within the jurisdiction of the court.
The sureties shall deposit the title documents in the registry of the court.
The sureties shall deposit three years tax clearance certificates which shall be verified as genuine by the EFCC.
He shall deposit his international passport with the registry of the court.
The sureties shall filed affidavit of means and residency which shall be verified by the EFCC. IN the case before Justice
Mohammed Idris while in the case before Justice Babs Kiewumi he was granted bail in the following conditions,
He was admitted to bail in the sum of N250milion with one surety
The surety shall be ordinarily resident in Lagos and shall be owner of built up property within Lagos metropolis.
The surety shall deposit original copy of property certificate of occupancy with the registry of the court.
The surety shall deposit four resent passports photographs, his international passport, depose to affidavit of means and show proof of payment of three year tax paid as at when due.
That where the surety is a civil servant or public officer he shall obtain a letter of introduction from an officer not below the cadre of a permanent secretary in either federal or state civil service and resident within Lagos State
The bankers of the surety shall write letter of introduction to indicate the age of the surety account with the bank. The prosecution inconjuction with the court registrar shall verify the surety as a suitable person as well as the property in issue.
The certificate of occupancy shall be verified by the land registry in Lagos
Dudafa shall deposit his international passport and four recent passport photographs with the court registrar
and despite meeting all the herculean bail conditions as ordered by the two courts, the Commission has failed to fulfill its part, by verifying all the title documents of his sureties.
He also stated that various attempts by his lawyer to ensure that the Commission deposit his international travel passport with the court since he was admitted to bail had proved abortive, irrespective of the fact that the two Courts at various sittings compelled and ordered it to release the said passport.
He also stated that the EFCC has also refused blatantly to verify all the title documents provided by his sureties at the Land Registry for over two months in relations to the bail conditions granted him by Justice Babs Kuewumi of a Lagos Federal High Court.
From the above facts, Dudafa stated that it has become obvious that the EFCC is desperate to keep him perpetually in prison with the ultimate aim of killing him in prison despite the fact that of his deteriorating state of health has been made known to the EFCC through a medical report dated August 29, 2016, and issued by the Nigerian Prison Service, Ikoyi, Lagos.
The former Special Assistant also stated that it is clear that the EFCC through its officials in STF3 is deliberately punishing him for his loyalty to former President Goodluck Jonathan and his family. Adding that his only sin was that he refused to yield to the Commission's pressure to write a false statements to incriminate the former first lady, Dame Patience Jonathan.
Dudafa, while seeking the intervention of the human rights Commission to come to his rescue, further stated that his State of health has continue to worsen on daily basis while he is being mischievously kept in prison as his survival is currently on the brink.
He therefore appealed to the Commission's Chairman to use his good and amiable office to imtervene speedily in his current predicament in the hand of the EFCC, as it is clear case of arbitrary abuse of power, flagrant disregard to court order and breach of his fundamental rights as a lawful citizen of Nigeria, as guarantee by the 1999 Constitution of Federal Republic of Nigeria.
